Government adopts new railway law

The Brazilian federal government has published Decree No. 11,245 from 21st October 2022, which regulates Law No. 14,273 of December 2021, known as the law of the railways. The decree has the objective of enabling private investment in the country's railway sector. The law will allow for the construction of new corridors, the use of idle line sections and the provision of rail transport services through the authorisation model. According to the Ministry of Infrastructure, by September 2022, a year after instituting the model of railway authorisations, 89 requests from the private sector had been registered from 39 parties. These requests add up to 22,442 km of new tracks in all regions of the country and an estimated investment projection of EUR 50.8 billion (BRL 258 billion). So far, the federal government and the private sector have signed 27 contracts for which authorisation to build rail lines has already been received. The projected private resources to be allocated for implementing these approved projects adds up to EUR 26.2 billion and 9,923 km of new tracks.
